1. Introduction

These terms and conditions ("Terms") apply to all patrons ("Patron" or "you") who visit or gamble at Elements Casino Mohawk, a land-based casino located in Ontario, Canada.

2. Definitions

For the purposes of these Terms, the following definitions shall apply:(a) "We", "Us", or "Our" means Elements Casino Mohawk and its officers, directors, employees, agents, successors, and assigns.(b) "You" means the Patron who visits or gambles at Elements Casino Mohawk.

3. Governing Law

These Terms are governed by and construed in accordance with the laws of Ontario, Canada.

4. Age Restriction

No person under the age of 19 is permitted to enter or participate in gambling activities at Elements Casino Mohawk.

5. Identification

To ensure compliance with applicable laws and regulations, We may request identification from you prior to allowing entry into our premises. You agree to provide true and accurate information as requested by Us.

6. Gaming Rules

Elements Casino Mohawk operates under the rules and regulations of the Ontario Lottery and Gaming Corporation (OLGC). These terms and conditions supplement such rules and regulations, but do not supersede them. We reserve the right to modify or change these gaming rules at any time without notice.

7. Patron Conduct

(a) You agree to conduct yourself in a manner that is respectful of other patrons and our staff.(b) No form of harassment, intimidation, or threatening behavior shall be tolerated on our premises.(c) The use of electronic devices such as mobile phones for unauthorized communication during gaming hours may result in your being asked to leave the premises.

8. Losses

You acknowledge that gambling involves risk and is subject to chance. We are not liable for any losses or financial hardship suffered by you while participating in our games.

9. Exclusion

We reserve the right, at our sole discretion, to exclude a Patron from participation on our gaming floor due to non-compliance with these Terms or applicable laws and regulations.

10. Disputes Resolution

All disputes arising out of or in connection with your visit or participation in our games shall be resolved through internal review by Us before any external dispute resolution mechanism is used.

11. Limitation of Liability

To the fullest extent permitted by law, We exclude all warranties, conditions, and representations whether express or implied. In no event shall we be liable for incidental, consequential, punitive or special damages arising out of or in connection with your visit or participation in our games, including loss of profits or business interruption.

12. Amendments

We reserve the right to amend these Terms at any time without notice. Your continued use of Elements Casino Mohawk's facilities and services shall constitute acceptance of such amendments.

13. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, that provision will not affect other provisions which shall remain in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and Us with respect to your visit or participation in our games at Elements Casino Mohawk and supersede any prior agreements, understandings, negotiations, or discussions between us.

By visiting or participating in games at Elements Casino Mohawk, you acknowledge that you have read, understood, and agree to be bound by these Terms.
